Avoiding Court Experts

Solicitors for Out-of-Court Divorce Settlements

At McAlister Family Law, our lawyers are experts and tactically sharp. They are acutely aware that there are no prizes for taking a case to court and doing so can be stressful and expensive.

That is why over 85% of cases are resolved outside of court. Our job is to apply judgment and secure the best available solution for you and your family.

How We Achieve Our Success Rate

Achieving an out-of-court agreement is a skill and is not one that can be achieved without tailored training, teamwork, and experience.

We only recruit lawyers who have the tactical skills and experience to create the right conditions to achieve a suitable settlement of a dispute.

  • We prepare a moving forward plan for all of our clients which provides a legal analysis and a range of options and strategies which will bring the case to an earlier resolution without court intervention.
  • We don’t just follow processes – we “think outside the box” and look for a resolution rather than the creation of obstacles.
  • We ensure that we are on the front foot at all times by encouraging early negotiation and the advancement of proposals for agreement.  Our team are expert in determining the timing for proposals and settlements as this is often key to bringing even the most difficult of cases to a head.
  • We obtain second opinions from our senior colleagues to ensure that we have everything covered

Ways to Achieve Out-of-Court Agreements

Our team of specialists uses various methods to achieve out-of-court agreements.

Negotiations

Agreement is possible at any time and can even take place once court proceedings have been issued and are underway. Such negotiations can take place by:

  • Email
  • Round table meeting
  • Video calls
  • Shuttle mediation (if appropriate)

Alternative Dispute Resolution (ADR)

The UK legal system is designed to encourage agreement out of court. If agreement cannot be achieved by direct negotiation it can often be achieved by mediation, arbitration, or collaborative means.
